Terms of Use

1. Agreement

These Terms of Use (“Terms”) form a legal agreement between you (“you” or “user”) and Sagi Levy, an individual operating the Otty iOS application and this website (“Otty,” “we,” “us,” or “our”). By downloading, installing, or using Otty, you agree to be bound by these Terms.

These Terms are the End User License Agreement (“EULA”) referenced in the App Store.

2. Eligibility

You must be at least 13 years old (or 16 in the EU/EEA) to use Otty. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Otty on iOS devices that you own or control, for your personal, non-commercial use. You may not:

• Copy, modify, or create derivative works of the app
• Reverse-engineer, decompile, or attempt to extract the source code
• Rent, lease, lend, sublicense, or transfer the app to any third party
• Remove or obscure copyright or other proprietary notices
• Use the app for any unlawful purpose
• Access the app through automated scripts, scraping, or bots

4. Subscription terms

Otty offers an auto-renewable subscription that unlocks the full experience.

Pricing

• Free trial: 30 days, starting from the date you start the subscription. Unless you cancel at least 24 hours before the trial ends, you will be automatically charged for the first paid period.
• Monthly plan: $1.99 per month (or local equivalent)
• Annual plan: $15.99 per year (approximately 35% savings vs. monthly)

Auto-renewal

Your subscription renews automatically at the end of each billing period. The renewal is processed by Apple through your Apple ID. Your Apple ID will be charged within 24 hours before the current period ends, at the then-current price. You can manage or cancel your subscription at any time:

• iOS Settings → [your name] → Subscriptions → Otty → Cancel Subscription
• Cancellation takes effect at the end of the current paid period; you keep access until then

Refunds

All purchases are handled by Apple and governed by Apple’s refund policy. To request a refund, visit reportaproblem.apple.com. We are unable to issue refunds directly.

Price changes

We may change subscription prices in the future. You will be notified before any price change takes effect and given the option to cancel before being charged the new rate.

5. Your content

You own the data you put into Otty: cycle logs, notes, preferences, and any content you create. We do not claim ownership over it. You grant us a limited license to store, process, and display your content only as necessary to provide the service to you and, if you pair with a partner, to that partner.

You are responsible for ensuring that you have the right to share any information you enter about another person (for example, partner data). Obtain their consent before sharing their cycle or personal data in the app.

6. Medical disclaimer

Otty is not a medical device and does not provide medical advice, diagnosis, or treatment. The content in the app, including phase guides, nudges, and any educational material, is for informational purposes only. It is not a substitute for professional medical advice. Always consult a qualified healthcare provider for any questions about a medical condition, fertility, contraception, or treatment. Otty must not be used as a contraceptive method.

If you think you may have a medical emergency, call your doctor or emergency services immediately.

7. Prohibited conduct

You agree not to use Otty to:

• Harass, abuse, or harm another person
• Upload content that is unlawful, defamatory, or infringing
• Interfere with or disrupt the service or its servers
• Attempt to gain unauthorized access to any account or system
• Violate any applicable law or regulation

8. Termination

You may delete your account and stop using Otty at any time. We may suspend or terminate your access if you breach these Terms or engage in conduct that we reasonably believe harms other users, us, or third parties. On termination, your license to use the app ends and we will delete your data in accordance with our Privacy Policy.

9. Disclaimers

Otty is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected.

10. Limitation of liability

To the maximum extent permitted by law, in no event shall Sagi Levy, Otty, or any affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the app.

Our total liability to you for any claim arising from these Terms or your use of Otty will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $25.

11. Indemnification

You agree to indemnify and hold harmless Sagi Levy and Otty from any claims, losses, liabilities, damages, costs, and expenses arising out of your use of the app, your violation of these Terms, or your violation of any third-party right.

12. Apple-specific terms

You acknowledge and agree that:

• These Terms are between you and Sagi Levy only, not with Apple. Apple is not responsible for the app or its content.
• Your license to use Otty is limited to use on Apple-branded products running iOS, iPadOS, or macOS, as applicable.
• Sagi Levy, not Apple, is solely responsible for providing maintenance and support for the app.
• Sagi Levy, not Apple, is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligations with respect to the app.
• Sagi Levy, not Apple, is responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
• In the event of any third-party claim that the app or your use of it infringes intellectual property rights, Sagi Levy (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that (a) you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and (b) you are not listed on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.

13. Governing law

These Terms are governed by the laws of [YOUR STATE/COUNTRY], without regard to conflict-of-law rules. Any dispute will be resolved in the courts of Los Angeles, California, unless mandatory consumer-protection law in your jurisdiction provides otherwise.

14. Changes to these Terms

We may update these Terms. Material changes will be notified in-app and by updating the “Last updated” date. Continued use of Otty after an update means you accept the revised Terms.
